Quantonomics GmbH, Stadelhoferstrasse 28.2, 8001 Zurich, Switzerland (hereinafter “Quantonomics”], is the author of this privacy policy. This Privacy Policy applies to all users of Quantonomics' services, insofar as personal data is processed. In particular, this includes customers who have concluded a contract with Quantonomics for services, their employees and visitors to the website. In addition, Quantonomics may declare the privacy policy applicable to other contractual partners on a contractual basis. For the sake of simplicity, all persons affected by the data processing are hereinafter referred to as “customers”.
Quantonomics is committed to the careful and conscientious handling of its customers' personal information. Quantonomics is responsible for the collection, processing, disclosure, storage and protection of personal information of its customers and ensures compliance with the Swiss Data Protection Act (“DSG”] as far as protected data of Swiss customers are concerned.
The consent given by customers with this data protection declaration can be revoked at any time with effect for the future.

2 Applicable law
The processing of data of Swiss customers is governed exclusively by Swiss law, in particular the Federal Act on Data Protection (revDSG, SR 235.1] and the associated Ordinance to the Federal Act on Data Protection (SR 235.11]. The EU General Data Protection Regulation (GDPR] does not apply. The applicability of the GDPR remains reserved (i] insofar as it is expressly provided for in this data protection declaration for sub-areas, and (ii] insofar as the GDPR is also mandatory for data of Swiss customers due to special circumstances.
3. Nature and scope of the collection of personal data
3.1 When visiting our website (without login]
When customers visit Quantonomics' online presence outside the login-protected area, the web server technology used automatically logs general technical visit information in so-called server log files, which the customer's Internet browser automatically transmits. This includes the user agent (browser type and version, operating system used], header information (referrer URL, IP address of the accessing computer], the time of the server request and the login status. These server log files are only merged with other data sources for error analysis.

4. Data security
Quantonomics uses technical and organizational security measures in accordance with recognized market standards to protect stored personal data against unintentional, unlawful or unauthorized manipulation, deletion, modification, access, disclosure or use and against partial or complete loss. Quantonomics' servers are located in Switzerland. Certain services may be processed via servers in other countries - with an appropriate level of data protection - whereby the requirements of the FADP are fully complied with at all times. The connection to the servers is made using SSL encryption. Quantonomics regularly backs up customer data (backup]. The security measures are continuously adapted and improved in line with technological developments. Quantonomics accepts no liability for the loss of data or its access and use by third parties. Furthermore, Quantonomics cannot guarantee the security of data transmission on the Internet; in particular, there is a risk of access by third parties when data is transmitted by e-mail.
5. Cookies and analysis tools
Cookies help to make your visit to the Quantonomics website easier, more pleasant and more meaningful. Cookies are information files that the web browser automatically stores on the hard disk of the computer when the customer visits the Quantonomics website and uses offers. The customer can independently manage the security settings in the browser and thus block or deactivate cookies used, whereby certain Quantonomics services may no longer be able to be used (in full].
We use the reCAPTCHA service from Google Inc (Google] to protect your requests via the Internet form. The query serves to differentiate whether the input is made by a human or abusively by automated, machine processing. The query includes sending the IP address and any other data required by Google for the reCAPTCHA service to Google. For this purpose, your input will be transmitted to Google and used there. However, your IP address will be shortened beforehand by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there. Google will use this information on behalf of the operator of this website to evaluate your use of this service. The IP address transmitted by your browser as part of reCAPTCHA will not be merged with other Google data. The deviating data protection provisions of Google apply to this data. 6. Purpose of the processing of personal data / recipients of the data
Quantonomics processes the collected data in order to provide and continuously improve the desired services, to maintain the business relationship with customers, to monitor and improve the performance of the offer, to detect, prevent or investigate illegal activities. The data may also be passed on to partner companies and service providers, selected third-party companies, institutes and/or legally authorized state authorities in Switzerland and abroad for processing, storage and use within the scope of the above-mentioned purposes. If the processing or storage of personal information takes place in countries that do not guarantee adequate data protection compared to Swiss data protection law, Quantonomics requests the processor under contractual obligation to fully comply with the relevant provisions of the DPA. Quantonomics has some of the above-mentioned processes and services carried out by service providers based in the EU or Switzerland who comply with data protection regulations. These are in particular companies in the categories of IT services that are used within the framework of order processing contracts.
7. Profiling / automatic decisions
Profiling is the automated processing of personal data in order to analyze or predict certain personal aspects or behavior. An “automated individual decision” is a decision that is made completely automatically, i.e. without relevant human influence, and that has negative legal effects or other similar negative effects on the customer. Quantonomics does not carry out automated individual decisions.
8. Contact form
If the customer wishes to contact Quantonomics via the website, Quantonomics requires an e-mail address and a name. The processing of the personal data entered in the contact form is based on the customer's consent, which is granted by pressing “Send”. Quantonomics stores the personal data provided by customers for the purpose of contacting us in a CRM system.
9. Duration of storage
Quantonomics processes and stores personal data for as long as the customer uses the service. It should be noted that the contractual relationship between Quantonomics and the customer is a continuing obligation that is intended to last for years. After termination of the contractual relationship, Quantonomics is generally not obliged to store the customer's data.
10. Rights of the data subjects
Within the scope of the data protection law applicable to you, data subjects have the right to information, correction, deletion, the right to restrict data processing and otherwise to object to our data processing as well as to the disclosure of certain personal data for the purpose of transfer to another body (so-called data portability]. Please note that we at Quantonomics reserve the right to assert the restrictions provided for by law. For example, if we are obliged to store or process certain data, if we have an overriding interest in doing so (insofar as we are entitled to rely on this] or if we need it to assert claims. Please note that the exercise of these rights may conflict with contractual agreements and may have consequences such as premature termination of the contract or cost consequences. We will inform you in advance if this is not already contractually or legally regulated.
The exercise of such rights generally requires that you clearly prove your identity (e.g. by means of a copy of your identity card, where your identity is otherwise not clear or cannot be verified]. To assert your rights, you can contact us at the address given in section 1.
Every data subject also has the right to enforce their claims in court or to lodge a complaint with the competent data protection authority. The competent data protection authority in Switzerland is the Federal Data Protection and Information Commissioner (www.edoeb.admin.ch].
